摘要
当前,中国特色社会主义进入了新时代。基于此,作为创新试验地的中国自贸区的知识产权战略具有顺应贸易便利化、促进投资管理改革、利于融资创新、推动知识产权机构法治化、推进知识产权国际合作等方面的独特内涵。为有效实现这些内涵,新时代中国自贸区知识产权战略需要更高度、更自觉的顶层设计,可采取在继续顺应国际趋势的基础上主动快速对接知识产权高标准的发展思路,并从坚持效率与公平的兼顾和坚持知识产权地域性管理为主两方面出发进行总体应对,从而不仅从国内角度满足日益增长的知识产权权利人需求,也有助于在国际上,从"被动"应对的规则执行者转型为"主动"参与的规则引领者,实现国际影响力的提升。
At present, it is a new era for developing socialism with Chinese characteristics. In view of this, as test sites for innovations, the Free Trade Zones in China must ensure that their intellectual property strategy should perform unique functions such as facilitating trade, promoting reforms in investment management, facilitating financing innovation, promoting the legalization of intellectual property institutions, and promoting international cooperation in intellectual property rights. In order to effectively realize these connotations, more top-level designs are demanded in the intellectual property strategies for Free Trade Zones in China in the new era. A possible thought is to actively and rapidly introduce high standards for intellectual property while continuously following international trends, and taking an overall response by balancing efficiency and fairness and sticking to the regional management of intellectual property rights. In this way, we are not only able to meet ever-increasing demands from intellectual property rights holders domestically, but also expected to complete the transition from passive executor of rules to active legislator of rules as to enhance China＇s international influence.
