摘要
依法治校与教授治学是现代大学内部治理的基本原则在我国大学理念和制度中的表现形式,依法治校是教授治学有效实现的基础和保障。目前,我国高校教授治学方面还存在着一些亟待改进的地方。基于依法治校,从高校内部权力耦合机制、组织融合机制、文化契合机制和法治保障机制等多方面进行优化创新,是促进我国高校教授治学有效实现的可行路径。
University governance by law and professors＇ academic governance are the conceptual and systematicexpression of the basic principles of modern university internal governance. University governance by law is the foundationand guarantee of professors＇ academic governance. Under the perspective of university governance by law,there are manypractical difficulties of professors＇ academic governance in Chinese universities. For instance,laws and regulations areimperfect;practices are representative of the rule of man;institutions are lack of flexibility and inspiration;academicorganizations are lack of autonomy. In the context of university governance by law,in order to promote the effectiveness ofprofessors＇ academic governance,Chinese universities should innovate the realization mechanism of professors＇ academicgovernance,including coupling mechanism of internal powers,including coupling mechanism of internal power,fusionmechanism of internal organizations,coincidence mechanism of administrative culture and academic culture,andguarantee mechanism of rule of law.
