摘要
随着经济全球化的发展,知识产权在国际竞争中发挥着越来越重要的作用,国家创新驱动发展战略对知识产权司法保护提出了新的要求。我国侵犯知识产权的犯罪数量增多、犯罪形式和手段发生变化,知识产权刑事保护面临着立法司法保护体系与国家创新驱动发展战略进一步相适应的要求和挑战。本文立足知识产权刑事司法保护中存在的问题,对我国目前知识产权刑事政策、相关法律规定和司法实践进行了深入剖析。在考量域外知识产权刑事立法经验的基础上,提出了我国知识产权刑事保护应坚持与国家知识产权创新战略相适应的刑事政策。在罪名设置、犯罪构成、刑罚设置等方面不断完善我国知识产权刑事立法,进一步加大知识产权刑事司法保护力度,以更好地实现知识产权刑事立法、司法与国家知识产权发展战略相协调,与民事行政保护相适应,准确打击知识产权犯罪,促使知识产权刑事保护更加适应建设知识产权强国的发展要求。
Along with the globalization, intellectual property plays an important role in international competition. And National Strategy of Innovation-Driven Development places greater demands on judicial protection of intellectual property. Because the rising number and changing means of intellectual property crimes, it is a challenge for the system of criminal protection of intellectual property to be compatible with judiciary and National Strategy of Innovation-Driven Development. This thesis aims to solve the problem of criminal protection of intellectual property, deeply analyses the policy of Criminal protection of intellectual property, intellectual property law and judicatory practice. This thesis proposes a policy of criminal protection of intellectual property which is compatible to innovation-driven development strategy absorbing the experience of foreign countries. In order to make the legislation and judiciary of criminal protection of intellectual property to match with National Intellectual Property Strategies and civil administrative protection system, to precisely combat crime, to make the criminal protection of intellectual property meets the demand of construction of powerful intellectual property nation, China should improve legislation on the defnition requirement and penalty of intellectual property crimes, strengthen judicial protection of intellectual property.
