摘要
社会保障水平和医疗水平的提高使人们参与劳动的年龄结构发生了变化,超过法定退休年龄的人员再继续工作现象愈发普遍,但劳动关系界定的封闭和复杂使这类用工关系在法律保护上存在不足,导致工伤认定在理论认知上不统一,实践操作中存在地区差异,并引发法院裁判结果不一,法律救济不畅通等问题,这要求重新构建合理的劳动关系概念,科学设置工伤认定程序规则,统一司法解释和其他规范性文件的概念界定和审判理念,以此回应当下超龄返聘人员工伤认定混乱的社会问题。
The improvement of social security and medical treatment brings changes in the age structure of labor force. It is increasingly common for those who have reached mandatory retirement age to work. However,the closed and complicated definition of labor relation makes deficient legal protection to such employment relationship,triggering a series of problems such as theoretically inconsistent identification of work-related injuries,regional differences in practice,discrepant judicial judgment results and ineffective legal remedies. All these require reconstruction of rational labor relations,scientific rules for identification of work-related injuries,uniform judicial interpretation,and definition and judgment of other normalization documents. These requirements answer to the chaotic identification of work-related injuries for overage reemployed personnel.
