摘要
最高投标限价指的是招标人在工程项目招标文件中设置的最高拦标价。设置最高投标限价的主要目的在于一方面是为了能够有效地提高招投标工作的成功率,防止流标的情况发生,更为重要的另一方面是为了控制工程造价投资。招标人依据《建设工程工程量清单计价规则》及相关计价依据,按照工程量清单计算出对招标工程限定的最高工程造价。设置最高投标限价有利于避免串通报价、围标、哄抬报价的行为,防止国有资产流失,可使招投标双方共赢,实现利润最大化。在招标初期从工程情况、设计、施工组织、施工方法、工期、质量、安全及市场供求情况、合同风险等因素综合考虑设置最高投标限价。
The price ceiling refers to the maximum bid price set by the tenderer in the bidding documents of the project. On the one hand, the main purpose of placing the price ceiling is in order to effectively improve the success rate of bidding and prevent the occurrence of the flow mark. On the other hand, more importantly, in order to control project cost investment, realize profit maximization. The tenderer shall calculate the maximum project cost according to the bill of quantities on the basis of ＂rules for the valuation of bill of quantities of construction projects＂. Setting price ceiling is conducive to avoiding collusion in quotation, bid closing and bid raising, preventing the loss of state-owned assets, and achieving win-win results and maximize profits. In the early stage of bidding, the highest bidding price is set according to the comprehensive consideration of the project situation, design, construction organization, construction method, construction period, quality, safety, market supply and demand, contract risk and other factors.
