摘要
《民法总则》是民法典之开篇,《民法总则》以《民法通则》为基础有所发展和创新。在结构上,《民法总则》大体延续《民法通则》的架构,其变化主要表现为:将基本原则调整为基本规定,新增非法人组织和期间计算,将民事权利的位置提前,将民事法律行为和代理分为两章,删除涉外民事关系的法律适用。在篇幅上,民事权利、民事责任的内容大幅简化。在理念上,《民法总则》重视人权保障,强调私法自治。在内容上,《民法总则》做了诸多改进:充实基本原则,规定适用规则,完善监护制度,突出胎儿利益,重构法律行为,细化代理制度,改革诉讼时效。《民法总则》的这些发展值得我们重视,然而,其不足亦应认真对待,以期在最终出台的民法典中加以完善。
General Rules of the Civil Lawis the first part of our civil code.Based on the General Principles of the Civil Law,General Rules of the Civil Law made some development and creation.General Rules of the Civil Law got the structure of General Principles of the Civil Law,but they are different in the following things：general principles are placed by general provisions;non-legal person organizations and calculation of duration are added;position of civil rights is placed in the front;civil juristic act and agency are divided into two chapters,and application of law in civil relations with foreigners is deleted.In length,the content of civil law and civil liabilities are simplified greatly.Ideally,General Rules of the Civil Law pay attention to the protection of human rights and emphasize the autonomy of private law.In the content of General Rules of the Civil Law,many improvements have been made which includes enriching the general principles,providing the application rules,perfecting the guardianship system,highlighting the interests of the fetus,reconstructing the juristic act,refining the agency system and reforming the prescription.We should pay more attention to the development of General Rules of the Civil Law,meanwhile,we should take its shortcomings seriously so as to improve it in the final civil code.
