摘要
用法文化的视野和法哲学的方法,能够深入探讨,从礼法到政法的传承与变迁中,传统与现代中国法的结构与哲学及其改造提升问题。传统中国法的结构是礼法结构,其哲学是道德哲学,其背后的世界观是道或者说是阴阳统一的世界观;现代中国法的结构是政法结构,其哲学是功利哲学,其背后的世界观是唯物论或者说是原子论的世界观;但它们最终要回答和追求的是同样的问题,即人是什么、人如何成为人、以及法对人成为人有什么价值。在未来中国法的结构与哲学的改造提升中,应弱化政法结构中政与法的意识形态性和功利性,注入基于普遍人性的人权和基于中国人性情和教养的礼,从而将其改造提升为新型的政法结构;其中最根本的是唯物世界观,亦即物质的功利的世界观、人生观、价值观和法律观,与道的或者说阴阳统一的世界观,亦即精神的道德的世界观、人生观、价值观和法律观的协调统一。从两种世界观的方法论和现今的立场出发,在未来中国法的发展中,上述两者的协调统一,虽有其艰难性,但亦有其可能性。
Based upon the view of legal culture and the method of legal philosophy, the issue of the structure and philosophy of law in traditional and modern China and their remolding and upgra- ding is discussed in the process of inheritance and transition from rite-law to politics-law. The struc- ture of law in traditional China is the structure between rite and law, whose philosophy is moral phi- losophy, and the world view behind is Tao or the unity of Yin （ the female principle） and Yang （ the male principle）. The structure of law in modern China is the structure between politics and law, whose philosophy is utilitarian philosophy, and the world view behind is materialism or atomism. However, both of the structures will eventually answer and pursue the same questions as what is hu- man being, how human being becomes human being, and what is the value of law to the fact that hu- man being becomes human being. The remolding and upgrading of the structure and philosophy of law in China in the future should weaken the ideological and utilitarian nature of politics and law in the politics-law structure and infuse human rights on the basis of universal human nature and rites on the basis of Chinese temperament, so that a new type of politics-law structure can be remolded and upgraded. Among the process, the most fundamental aspect is the harmonious unity between the worldview of materialism which means materialist and utilitarian view of the world, of life, of value and of law and the worldview of Tao or the unity of Yin and Yang which means spiritual and moral view of the world, of life, of value and of law. Starting from the methodology of the two worldviews, it is difficult to realize the harmonious unity of them in the development of law in China in the future, but the possibility still exists.
