摘要
台湾居民具有中国国籍,属于中国公民,理应根据《宪法》规定赋予其平等权,依法与大陆居民享有同等待遇。随着30年来两岸关系的交流与发展,台湾居民在大陆的经济、社会、文化和政治等各领域权利逐渐丰富,但也存在部分与大陆居民的差别待遇。在两岸尚未正式结束敌对状态的情况下,基于国家安全、社会公共利益的整体价值以及两岸分属两个"法域"的客观实际,大陆方面对台湾居民的部分权利做出限制,只要在必要而合理的限度内,并不必然违反平等原则。未来,推进台湾居民在大陆的同等待遇,应与大陆的经济社会发展水平相适应。鉴于"台独"分裂势力始终不遗余力地构建将两岸民众相互隔离的社会环境,大陆也应更加依靠单边政策驱动,加快实现对两岸居民的一体化对待,从而体现两岸同属一个国家的法理和事实。
The Taiwan residents have the nationality of China and are Chinese citizens. Thus they shall share equal treatment with the China's Mainland residents as provided by the Constitution. With the development of Cross-strait relations during the past thirty years, the Taiwan residents enjoy a wide range of equal economic, social, cultural and even political rights as the Mainland residents, but some differential treatment remains. Before the two sides of the Strait formally agree to cessation of hostilities, due to the consideration of national security and public benefit as well as the reality that two ＂legal territories＂ exist across the Strait, it is not necessarily to violate the principle of equality even that the China's Mainland limits some of the rights of the Taiwan residents in a necessary and reasonable way. In the future, the promotion of equal treatment of the Taiwan residents should be consistent with the economic and social development of the China's Mainland. Since ＂the Taiwan＇s pro-independence force＂ has been trying to build a clinic-isolation environment across the Strait, the China's Mainland should formulate unilateral policy to achieve the equal treatment of people across the Strait, and thus reflect the jurisprudence and reality that both sides of the Strait belong to One China.
