摘要
经济全球化、贸易自由化背景下,市场和竞争愈发国际化,企业的限制性商业做法和违反竞争行为随之增多且出现跨国特征,此时如果缺乏一个有效的国际协调法律框架,这些反竞争行为势必会损害市场效率,不利于全球经济的长远发展。20世纪末21世纪初,关于竞争政策的议题曾进入WTO框架讨论,最终以失败告终。近年来,各国纷纷转而通过区域贸易协定实现区域内的竞争政策合作,并取得了一定成果。通过对区域贸易协定中竞争章节的内容规定、实践运用、现有缺陷的研究不仅有利于加强区域内竞争政策协调机制的构建,同时对我国开展竞争政策的区域合作有较强的现实意义。
With economic globalization and trade liberalization, markets and competition have become increasingly intemational- ized, restrictive business and violation of competition practices have more transnational features. If there is no effective interna- tional coordination legal framework, these anti-competitive behaviors would undermine market efficiency. At the end of 20^th cen- tury and beginning of the 21^st century, competition policy had entered the WTO framework but ended in failure. In recent years, many countries have turned to regional trade agreements to achieve competition policy coordination. The research of content regu- lations, practical applications, and existing defects in the competition chapters of RTAs will not only help to strengthen the coor- dination mechanisms of competition policies in regional areas but also has strong reality value for China＇ s regional competition policies cooperation.
