摘要
在工程建设领域,行为人在签订工程施工合同过程中,骗取多名被害人巨额保证金的事件屡见不鲜。从此类"骗保"型犯罪的基本构造和市场诱因看,当前建筑行业过于依赖市场自由调节会给行骗人提供许多可乘之机,也给被害人造成难以挽回的损失。为更好地规制和预防此类犯罪,司法机关应根据当前建筑市场发展态势,平衡各方利益,政府在建筑市场应发挥好有效监管、维护契约、统一市场的作用。
In the field of engineering construction, it is not rare for the perpetrators to defraud victims＇ huge sum of security deposit in the process of construction contract signing. Studies on the basic structure and market incentives of such crime of ＂defrauding security deposit＂ reveal that the construction industry relies too much on the free adjustment of the market, thus providing opportunities for the frauds and causing irreparable losses to the victims. In order to regulate and prevent such crimes, the judicial authority should balance the interests of all parties according to the current situations of the construction market, and the government should effectively play its role in ensuring the effective supervision and safeguarding the validity of contract and a uniform market.
