摘要
随着审判中心主义下诉讼改革的推进,警察出庭作证已由过去的"偶尔为之"逐渐成为一项制度化措施。然而,实证调研数据显示,警察出庭作证制度在具体的贯彻落实中,依然面临着诸多的制度障碍和现实难题。对此,建议通过从犯罪追诉到法庭助手的观念转变,培育警察出庭作证的自觉性和主动性;从侦查中心到审判中心模式的转型,规范侦查办案人员的调查取证行为;从卷宗笔录移送到庭审实质化的改革,倒逼警察出庭作证能力的提升;从诉讼构造的线性分立到侦控结构的整合优化,完善警察出庭作证的内部机制衔接和外部制度环境。
With the advancement of the reform on trial-centered lawsuit system, police＇s testifying in court, which was an occasional event in the past, has gradually formally regulated. However, the data of our empirical study reveals that, the system of police＇s testifying in court still faces many institutional obstacles and practical problems in the actual implementation. In this regard, this paper puts forward the following suggestions： enhancing the police＇s consciousness and initiative to testify in court through changing their ideas of being crime investigators to court assistants; regularizing the investigators＇ behaviors in obtaining evidence by transforming the investigation-centered mode into the trial-centered mode; improving the police＇s ability to testify in court by the changes from file and document transfer to the substantive court trial, and improving both the internal mechanism connection and the external institutional environment for police＇s testifying in court via the linear separation of lawsuit structure and the optimization of the investigative structure.
