摘要
针对我国土地征收冲突频发的现状,从程序公正的角度出发,研究当前我国征地程序中被征地农民程序性权利设置的缺失,以及现有程序性权利的实现和救济存在的困难。在此基础之上,立足于我国市场经济深入发展的现实,探讨如何科学地设置被征地农民的程序性权利,完善已有的知情权、监督权、参与权,并探讨新增征地合法性异议权、补偿议价权、停止执行请求权等的可能性和路径,以期为完善我国征地制度提供可操作性参考。
To solve the conflict of land expropriation in China, from the perspective of procedural justice, the paper analyzes various deficiencies of procedural rights setting for land expropriated object, as well as the existing difficulties of realization and relief of procedural rights in the current land expropriation procedures. On this basis, relying on the in-depth development of China＇s market cconomy, this article discusses how to scientifically set up the existing procedural rights of the landless peasants, including rights of knowing, supervision, and participation. In order to improve Chinese land expropriation system, we also suggests landless peasants should be given new procedural rights to question legitimacy of land expropriation, to bargain for compensation and to stop the execufion of land expropriation.
