摘要
随着全球经济的一体化,各国间的交流日益频繁,但由于经济发展的不均衡,以及犯罪分子为了寻求利益的最大化,跨境刑事犯罪问题日趋凸显,也引起了各国法学界的关注。由于开放步伐不断加快,黑社会犯罪案件、毒品犯罪案件,有组织偷越国边境案件、跨境经济案件等跨境有组织犯罪在我国也呈现不断上升趋势。特别在沿海、沿边地区,这类犯罪甚至成为了影响当地社会治安稳定的一项重要原因。云南与越老缅三国接壤,有着特殊的地理环境,这也形成了有地域特色的跨境有组织犯罪。因此,如何加强对跨境有组织犯罪的研究,提升跨境有组织犯罪打击能力,也成为了我国犯罪学研究的新课题。
With the integration of the global economy, exchanges between countries are becoming more frequent. Due to the imbalance of economic development, and criminals seek to maximize profits, the problem of cross-border criminal offences is becoming more and more prominent, it has attracted the attention of legal scholars in various countries. As the pace of opening continues to accelerate, the criminal cases in the underworld, the cases of drug crimes, the organized crime of stealing across the border of the country, and the cross-border economic cases are also increasing in our country. Especially in coastal areas and border areas, such crimes have even become an important factor affecting the stability of local social security. Yunnan is bordering on Vietnam, Laos and Burma, it has a special geographical environment, which also forms a cross-border organized crime with regional characteristics. Therefore, how to strengthen the research on cross-border organized crime and enhance the ability to strike cross-border organized crime has also become a new topic of criminology research in China.
