摘要
公证证据保全是不同于公证机构的证明行为的保全行为,是公证机构行使保全职能的体现。作为与法院证据保全并行的证据保全种类之一,公证证据保全具有以下优势:更为便捷、高效、专业;更具中立性;责任追究机制更为完善;提升当事人的取证能力。公证证据保全的相关不足主要存在于以下几个方面:公证证据保全与《民事诉讼法》的衔接;公证证据保全与法院证据保全的运行关系;公证人员在公证证据保全行为中的定位。应从以下方面进行完善:《民事诉讼法》明确赋予公证机构保全证据的主体资格,明确公证机构保全的证据的效力;诉前鼓励选择公证证据保全,诉中也可以申请公证证据保全;明确公证人员在公证证据保全中亲自取证的地位。
The preservation of notarial evidence is the preservation behavior of proof behavior different from the no- tarial institution, and it is the embodiment of the notary office' s exercise of its preservation function. As one of the types of preservation of evidence in parallel with the preservation of the court evidence, the preservation of notary evidence has the following advantages: more convenient, efficient, professional; more neutral; the accountability mechanism is more perfect ; and enhance the ability of the parties to obtain evidence. The inadequacies of the pres- ervation of notarial evidence are mainly in the following aspects: the link between the preservation of notarial evi- dence and the civil procedure law; the relationship between the preservation of the notary evidence and the opera- tion of the evidence preservation of the court ; the positioning of the notarial personnel in the preservation of the evi- dence of the notarization. It should be perfected from the following aspects: the civil procedure law clearly endows the notary body with the main body of the evidence preservation and the validity of the evidence preserved by the notary agency ; it is necessary to encourage the selection of the evidence for the preservation of the notary evidence, and to apply for the preservation of the notarial evidence in the prosecution, and to clarify the status of the notarial personnel to obtain the evidence personally in the preservation of the notarial evidence.
