摘要
招募人员是恐怖活动组织发展壮大、有效实施恐怖活动的重要支撑,而资助恐怖主义招募是恐怖主义融资的重要方面。恐怖主义招募可以分为主动招募和被动招募,其对资金的需求存在较大差异,其资金主要来源于恐怖活动组织的支持、捐款(包括滥用非营利组织)、犯罪活动收益等,主要用于招募者的个人花费、招募材料的制作与传播、为新成员提供帮助而支出的费用等方面。为了有效防控恐怖主义招募融资犯罪,有必要深入把握恐怖主义招募融资规律,完善我国反恐怖融资刑事法律,加强反恐怖融资侦查部门、监管部门、金融情报部门及反恐怖情报部门间的合作,以及这些公权力部门与金融机构及特定非金融机构间的合作,同时加强国际金融情报信息共享交流、国际定向金融制裁等国际合作。
Recruitment is an important support for the development and expansion of terrorist activities and the effective implementation of terrorist activities,while financing terrorism recruitment is an important aspect of terrorism financing. The recruitment of terrorism can be divided into active recruitment and passive one. There are larger differences concerning capital needs between them. The capital mainly comes from the support of terrorist organizations,donations( including abuse of non-profit organizations),and benefits of criminal activity. It is mainly used for personal expenses, production and dissemination of recruitment materials,and the cost for new members,etc. In order to effectively control crimes of terrorism recruitment and financing,it is necessary to further grasp the regularity of terrorism recruitment and financing,improve criminal laws on counter-terrorism financing,strengthen cooperation among counter-terrorism financing investigation departments,regulators,financial intelligence departments and counter-terrorism intelligence departments,as well as cooperation between departments of public power and financial institutions and non-financial institutions,and at the same time,enhance international financial intelligence information exchanges and international targeted financial sanction.
