摘要
随着大数据时代的到来,人才跨国流动的动态数据具有了全新的功能与属性,国际化的职业社交平台扮演了跨国人才流动海量数据的存储与使用者,从而使人才数据的主权属性(数据主权)、隐私特质(人格权)与商业价值(财产权)同时凸显,并相互交织。以LinkedIn、Edmodo、Research Gate、Academia.edu、Bharatstudent等为代表,国际化的职业社交平台不仅汇集了最大规模的国际人才数据,而且深刻改变了全球人才大争夺的路径及重心,甚至开始呈现"数据垄断"和"一言堂"的格局。中国已经进入了国际人才的"常态化流动周期",亟须通过促进本土猎头拓展国际业务、创设中国本土的国际化职业社交平台、加快建设国际人才大数据平台与云服务系统等途径,有效维护并有力争夺国际人才数据权。
The dynamic data of trans-national migration of Rencai takes on completely new function and attributes in the context of Big Data, while international social platforms play a role of storager and user of those data. Consequently, the territorial attribute(sovereignty of data), trait of privacy(personality right) and commercial value(property right) emerge simultaneously and interweave each other. Those international social platforms(such as Linked In、Research Gate、Academia.edu) assemble the maximal data of international Rencai, deeply change the path and core of global context for Rencai, and even takes on the configuration of data monopolization and dictatorial rule. Now China has met the Period of Normal Migration, and so has to vigorously protect and contest for the right to those international Rencai data by promoting the international business of local headhunting companies, building up China-based international social platforms, and setting up the platform of Big Data of international Rencai and Cloud-Service system.
