摘要
全面从严治党是新时代中国特色社会主义的基本方略,是中国共产党通过强化"打铁必须自身硬"所推动的国家的重要政治活动。从国外的经验来看,政党内部治理形成了美国通过宪制结构抑制政党的麦迪逊主义和德国的政党内部民主模式。中国共产党推进党的建设新的伟大工程,通过管党治党始终保持先进性和纯洁性,具有强烈的宪法意义和社会主义民主政治发展的价值,这对于政党与宪法发展、与民主政治建设的关系来说是一项全新的事业。全面从严治党的理论基础、逻辑框架和制度建构能够从宪法中获取资源,亦受到宪法激励。党的自身建设有利于加强和完善党的领导,实现宪法目标,推动宪法发展。中国共产党推进全面从严治党,与宪法和宪法秩序之间形成一种互动结构,它们是理解中国宪法秩序和宪法发展的基础,也是中国特色社会主义民主政治的重要形式。运用宪法工程分析全面从严治党,有利于打通党建理论与宪法和法治理论,以党建工程带动社会主义国家宪法工程。
Exercising full and rigorous governance over the Party is a basic strategy for advancing socialism with Chinese characteristics for a new era. It is an important political activity of the country promoted by the Chinese Communist Party in breathing new meaning into the Chinese adage"to forge iron,one must be strong". Based on the study of foreign experience,there are two forms of self-governance in political parties: the Madison doctrine in the USA which restraining political parties through constitutional structure and the German pattern of internal democracy within the political parties. Ensuring Party self-governance is exercised fully and strictly to maintain the Party's advanced nature and purity,the great new project of Party building that is just getting into full swing has strong constitutional significance and the value of developing socialist democracy. It is also a brand new great cause in view of the relations between the Party and the constitutional development,the Party and the development of democratic politics. The theoretical foundation,logical framework and institutional construction of full and rigorous governance over the Party can obtain resources from the Constitution and can also be inspired by the Constitution.The self-building of CPC is conducive to strengthening and improving Party leadership,achieving the goals of the Constitution and promoting the development of the Constitution. CPC's exercising full and rigorous governance over itself builds the interactive relationship with the Constitution and the constitutional order. It is the basis for understanding the constitutional order and constitutional development of China and it is also an important form of the socialist democracy with Chinese characteristics.To apply constitutional engineering to the analysis of the full and rigorous governance over the Party is conducive to bridge the theory of party building with the Constitution and the rule of law theory Meanwhlie,the Party-building project also drives forward the constitutional eng
