摘要
惩戒权之惩戒一般包括经济罚和非经济罚两类。惩戒权之经济罚存在三种相互博弈的理论:一是罚款"肯定说";二是罚款"否定说";三是罚款"替代说"。罚款"肯定说"及"否定说"较为传统。罚款"替代说"介于罚款之肯定与否定之间,是在否定罚款的大前提下,主张将减薪或降薪作为罚款的替代产品。相比较而言,罚款"替代说"比较合理可行,应当成为惩戒权之经济罚的主要内容。
Punishment in punishment power generally include economic punishment and non-economic punishment. There are three kinds of game theories of economic punishment in punishment power： the first is the ＂positive argument＂ of fines; the second is the ＂negative argument＂ of fines; and the third is the ＂replacement argument＂ of fines. The ＂positive argument＂ and ＂negative argument＂ of fines are more traditional. The ＂replacement argument＂ of fines is belween the positive and negative arguments of fines, which advocates replacing fines with pay reduction or salary reduction in the major premise of negating fines. In contrast, the ＂replacement argument＂ of fines is more reasonable and feasible, and should be the main content of economic punishment in punishment power,
