摘要
在"认定-指责-主张"的争端转型分析框架下,争端转型反映了社会结构变量,以及当事人的性格特质。大量的冲突其实仅存在于争端萌芽的早期阶段,受伤害的经历没有被认定为伤害,"认定"并没有转化为"指责",或是"指责"没向责任人主张都阻断了争端的进一步发展。尘肺病事件已经成为我国重大的公共卫生和社会问题,本文对"开胸验肺事件"、"甘肃古浪尘肺病事件"与"辽宁省朝阳县尘肺病事件"三件与劳动者职业卫生保护权利相关的典型事件进行争端转型分析,指出显性化为劳动争议的仅是存在于劳动领域中的社会冲突的一小部分。受害者对侵害经历的"容忍力"、"指责冷漠",以及"抗争精英"的抗争行为和权利意识均影响到争端转型为成熟的争议。通过正式途径获取正义的困难可能引导当事人寻求替代的纠纷解决路径,如若无效,最终肯定会引发新的社会矛盾。良序社会应当最小化抑制指责、主张的出现及其转化障碍,避免引发对个人和社会所不欲的后果。
Under the analytical framework of the conflict transformation of “affirmation-denouncement- proposition”, the conflict transformation reflects social structure variables as well as the personality traits of all parties. In fact, a large number of conflicts exist only in the early stage of conflict, so the injured experience is not recognized as injure or the “affirmation” is not transferred into “denouncement” or the “denouncement” is not advocated to the part in charge so as to stop the further development of the conflict. At present, the pneumoconiosis event has become a major public health and social issue. The three typical events associated closely with occupational health protection rights like “open-chest lung examination”, “pneumoconiosis in Gulang of Gansu province” and “pneumoconiosis in Zhaoyang of Liaoning province” is analyzed by means of the conflict transformation in this paper. It turns out that the domination of labor dispute only occupies a small fraction of social conflicts in the labor field. Victims’ tolerance to its injury and the grievance apathy as well as the protest groups’ resistance behaviors and his sense of entitlement affect the dispute from the conflict to the mature dispute. If the approach to get “justice” from the law is difficult, the concerned party may turn to some other access to resolute the disputes. But if still invalid, a new social contradictions will break out ultimately. A healthy social order is one that minimizes barriers inhibiting the emergence of grievances, propositions and the transformation obstacle in order to avoid the production of serious social consequences for both the society and the individual.
