摘要
在中国古代,人们多用道德语汇谈论法律问题。"恩义""情义""仁义"皆反映法律领域中的一对基本矛盾或主要范畴——"情法"关系。"恩""义"是古代中国人际关系的两个构成原理,前者指因血缘而产生的生育、养长与扶助关系及亲情;后者指非血缘关系人之间的相处之道、之理,基础义为情谊、道义、缘分,扩展为原则、义理、法理。"情"与"恩"同,可单用,可连用,多用于血缘亲情范围。"情""义"对举,两者相反相成,"情"指值得怜悯的客观情状以及人们对此产生的怜悯情感;"义"与"法"同,侧重原则、法理。"仁"与"恩"相近,"仁至义尽",含有"情法两尽"意味。
In ancient China,people usually talked the issue of law in terms of morality.These three concepts,"gratitude","friendship"and"benevolence",all reflected the basic relation between emotion and law in the legal field."Kindness"and"righteousness"were the two fundamental principles while people dealing with the relationship of human beings,the former basically was coming from the relationship of families and relatives based on blood,the latter was mostly referred to the relationship not based on the blood but based on principle of kindness,such as friendship,benevolence,etc.,their meaning could be extended to be meant principles,theory of righteousness,and theory of law.These two concepts friendship and righteousness are both opposite and complementary.
