摘要
作为我国自主研制的全球导航系统,北斗卫星导航系统在不断取得技术进步的同时却也面临着法律规制的缺失。这一缺失主要体现为两个方面:第一,现有规定以政策为主,缺乏法律层面的制度保障;第二,现有政策不完备,难以满足现实需要。通过对于美、俄、欧盟之卫星导航系统立法与政策加以分析,可为解决上述困境提供启发。针对现有规定以政策为主,缺乏法律保障的问题,我国应在立法模式及立法内容的选择上借鉴俄罗斯之立法经验。针对现有政策不完备,难以满足现实需要的问题,我国应在部门、军民间协调机制的建设方面重点借鉴美国及欧盟之相应政策与立法,并在兼容性与互操性的提升方面吸取美、俄政策中之合作共赢理念。
As a self-developed global navigation system, though having made continuous technicalprogresses, BeiDou Satellite Navigation System still faces barriers regarding its legal regulation. The barriers canbe mainly divided into two aspects： firstly, there is no legislation to regulate the development of BeiDou Systemby far; secondly, the existing policies are incomplete and therefore can not meet with the needs of the reality.It provides inspirations for overcoming the barriers by analyzing the legislations and policies of U.S., Russiaand EU concerning GNSS. With respect to the lack of legislation, China is required to decide its legislationmode and content basing on the legislation experience of Russia. Regarding the failure to satisfy the needs ofthe reality, China is supposed to coordinate the relationship between different government departments as wellas military and civil use absorbing the corresponding policies and legislations of U.S. and EU, while enhancingcompatibility and interoperability absorbing the idea of cooperation embodied in the policies of U.S and Russia.
