摘要
信息技术的发展已将我们置身于微媒体时代,微媒体在给工作、生活、学习等带来诸多便利的同时,也引发了一些社会、经济方面的法律问题,需要对其加强法治化治理。本文结合微博,在总结我国立法现状的基础上,从立法、起诉及证据等环节分析现有法律法规的不足之处,明确微媒体监管对象、确定监管内容及把握监管尺度,提出构建完善的法治化治理体系、加强法律制度建设、准确界定运营商的法律责任及重视媒介素养教育等对策。
The development of information technology has placed us in the era of micro media, while the micro media brings a lot of convenience to work, life, study and so on, it also led to some legal issues of social, economic aspects. So we need to strengthen the rule of law for micro media. According to micro-blog, based on the summary of China’s current legislation situation, the paper analyzed the deficiency of existing laws and regulations from legislation, prosecution and evidence. We cleared regulatory object, determined regulatory content and balanced regulation scale, then proposed to build perfect system of rule by law governance, strengthen the construction of legal system, accurately define the legal responsibility of operators, attach great importance to media literacy education, and so on.
