摘要
随着大数据、信息化时代的来临,知情权、隐私权与媒体执业权之间的关系变得复杂,权利紧张与冲突客观存在且时有发生。科学界定三种权利的关系及其权利架构,明确其在法治国家与民主社会中的功能定位,凸显权利界定与互动的宪治价值,以利于强化和保障公民基本权利,促进社会稳定和谐与进步。
With advent of information and big datas era, the relation between the right to know, privacy right and media practice right turns to be all the more complicated. There is objective existence and frequent outbreaks of tension and conflicts between rights. Accordingly, efforts should be made to define the relationship among the right to know, privacy right and media practice right as well as their framework, make sure of their function orientation in the democratic society and rule-by-law states, highlight right definition and rule-by-constitution values so as to intensify and protect the masses＇ fundamental rights, and facilitate social stability and progress.
