摘要
相关市场界定一直是司法机关审理互联网垄断案件的棘手难题。本文通过对我国相关市场界定的司法现状及其困境分析发现，与互联网特性相匹配的双边市场理论的缺失与技术手段的匮乏，是阻碍司法机关界定相关市场的难点所在。对此本文提出，在双边市场条件下，司法机关界定相关市场的方式应结合互联网行业的双边市场结构做出调整。首先应树立正确的相关市场界定意识，其次应根据双边市场的类型确定竞争约束的来源市场，最后完善市场界定的技术方法对市场范围进行准确测量。
The definition of relevant markets has always been a thorny challenge for ju dicial organs to handle antimonopoly cases in the Internet industry. This paper investi- gates and explores the status quo of the definition of relevant markets in China and their defects. The data analysis shows that the lack of two-sided market theories and technical methods, which match with the characteristics of the Internet, represents an insurmountable gap for judicial organs to define relevant markets. Therefore, this paper further demon- strates that the judicial organs shall adjust the ways of defining relevant markets by tak- ing into account the two-sided market structure of the Internet industry. We should deter- mine the source market with competitive restraint according to the type of two-sided mar- kets, and finally improve the technical methods for the definition of relevant markets to detect the scope of market and provide a fundamental solution for the dilemma of judicial organs in defining relevant markets.
