摘要 劳动基准、集体谈判和劳动保障监察是劳动法实现劳动者权益保护的三种基本制度。其中,集体谈判和劳动保障监察分别是劳动基准实施的第一道屏障和最后防线。在我国当前形势下,为保证劳动基准的有效遵守,需要克服工会的不完全独立性,增强工会代表职工与企业进行协商谈判的能力;强化劳动保障监察职能,完善劳动基准实施的监察保障机制;增强企业的社会责任意识,健全企业实施劳动标准状况的评价机制,从而使制度的运行机制形成良性互动,切实保障劳动者的基本权益。 Labor benchmark,collective bargaining and labor security supervision are three main basic systems that ensure labor's interests protection.Respectively,collective bargaining and labor security supervision are regarded as the first par-close and the last defense for labor benchmark implementation.Under the situation of our country now,in order to guarantee the abidance of the labor benchmark implementation,it is essential to build up the negotiation capability of the Labor Union representatives by overcoming the incomplete independency of the Labor Union;to consummate the supervision system for labor benchmark implementation by consolidating the labor security supervision system;to enhance the social responsibility consciousness for corporations and to complete the evaluation system for implementation of labor standard for enterprises,so that a positive interaction of the system can be established and labor's basic interests can also be secured.
