There are double attributes of public and private products for the trademark.The trademark law is a law of encouraging competition and law-enforcement,punishing breach of law,and constructing market economic order.Through protecting the trademark owner's exclusive use right and the public's referential use right,the trademark law corrects market malfunction,protects consumers' rights,increases market efficiency,promotes orderly competition,and increases accumulation of human spiritual wealth.
