摘要
三十年来,中国绝大多数经济法学者是在法学研究方法层面上使用"经济法学方法论"这一概念,在对经济法学研究方法的研究上取得了不少成果,促进了经济法学的发展。但总体上看,经济法学界对经济法学方法论的研究明显不足,方法论意识需加强。鉴于法理学界对法学方法论的争议,为了规范学术研究,可对经济法学方法论进行广义和狭义界分。狭义的经济法学方法论即经济法解释学应当成为未来经济法学方法论的主流,这是经济法学"回归"法学的必然要求。
The purpose of the text is to clarify the meaning of methodology of economic law,make economic law scholars pay more attention to the fact that there has been a lack of study about methodology of legal science,method of linguistic analysis and method of economic analysis in the research of economic law through the carding of previous discussions about methodology of economic law.The author hopes to change the bad trend of hollowing-out economic law study,reduce unnecessary academic dispute,promote the formation of accredited point of view about economic law by changing methodology.
