摘要
近年来,我国铁路事业特别是高铁事业取得快速发展,不仅研制出了具有自主知识产权的"复兴号"中国标准动车组,印尼雅万高铁、中泰铁路、中老铁路等多项"走出去"项目也相继落地,为"一带一路"建设起到了服务支撑作用。但是,铁路行业部分技术领域创新资源浪费现象仍个别存在;与国外企业相比,我国铁路行业仍然面临海外专利布局不足的劣势;针对"走出去"项目的知识产权风险联合应对机制仍未有效建立。这些都影响了我国铁路企业的市场竞争力。通过调查和分析国内外其他产业的典型案例,发现专利联盟在提升行业协同创新能力、保护自主知识产权、应对海外知识产权风险等方面均起到了积极作用,也为当前我国铁路行业保护自主研发创新成果、共同防范海外知识产权风险提供了启示。
The recent years have seen rapid development of railways, especially high speed railways in China. The China standard EMU "FUXING" train with independent intellectual property rights has been developed, the "go-global" projects, such as Djakarta-Bandung HSR, China-Thailand railway and China-Laos railway have been going smoothly, which support the roll-out of the "One Belt and One Road" initiative. However, the railway industry still faces with some problems which harm the market competitiveness of Chinese railway companies, e.g. the wasting of innovation resource still exists in some technical field; the overseas patent portfolio is insufficient; an united coping mechanism for intellectual property risk of "go-global" projects has not been built up. Based on case study of other industries outside China, it is found out that the patent pool plays an active role in terms of enhancing industrial collaborative innovation ability, protecting independent intellectual property and coping with overseas intellectual property risk, etc., providing China railway with inspirations of protecting innovative products and jointly guarding against overseas intellectual property risks.
