摘要
我国户籍管理制度是一项基础性社会管理制度,其主要法律基础是1958年开始施行的《户口登记条例》。随着经济社会发展和户籍制度改革的推进,有必要对该条例进行修订。同时,当代学者们围绕户籍法律制度进行了广泛而深入的研究,在户籍法律历史沿革、户口登记具体项目、法律如何回应改革以及立法技术等方面取得了丰硕研究成果。修订条例时应去伪存真地吸收、借鉴学者们的思路和建议,对法律名称与立法层级、立法宗旨与原则、框架结构与主要内容、与其他法律的关系等进行周密考虑。
Chinese household registration system is a foundational social administration system, its main legislative authority is the household registration act which came into force in 1958. With the economic and social development and the reform of household registration system, it＇ s necessary to revise the act. Meanwhile, scholars carry out extensive and in-depth research of the household registration law system, achieving a great deal of results in the historical evolution of household registration law, specific registration items, response of law to reform and legislative technique. These thoughts and suggestions should be properly absorbed in the revision, with considering the name of act, legislative level, legislative purpose, legislative principle, frame structure, main content and the relationship with other acts carefully.
