摘要
改革开放前后,围绕着中国专利法的酝酿和诞生,专利法的比较法研究应运而生,对于专利法的专业化、现代化和国际化贡献巨大。因为受当时历史条件,初期的比较法研究存在一些不足。但是,随着专利事业的发展、专利大国的建设,这些不足也逐步被克服,专利法比较法研究也在升级和更新,在研究宗旨、方法、主体和范围上日益成熟。
Before and after the Reform and Opening-up Policy of China, comparative law study emerged as the times required for the legislation of patent law. It made magnificent contribution to the specialization, modernization and internationalization of patent cause at that time and until now. However, those studies held some deficiency because of the historical condition. As the rise of Patent Power State due to the patent undertaking of China, comparative law study of patent law also evolved quickly and made great progress in tenet, scope, pursuer and method.
