摘要
宪法在法理上的基本属性各自对应一种宪法的发展形态。古希腊哲学家将宪法(政体)问题同人类寻求更好的生活方式相关联,尔后宪法逐渐表现出同统治、治理、权力、权利以及法律的环环相扣,无不在演绎同人类生活相关的各种主题。宪法最早被视为统治正当性的基础与明证,以政权确认为基本特征,表现出强烈的政治色彩。随之而来的,其法律属性被着力挖掘,宪法因其法律特征实现单纯的价值性意义向兼具工具性意义的转变。最终,宪法必然适应社会发展的需求,同社会主体、社会权利建立更为紧密的联系,完成对现代社会的型构与支撑之重任。
