摘要
立法的功能决定了它对实现利益的调整能够发挥重要的作用,同时也是建设中国特色社会主义法治的必然要求。在改革开放的背景下,我国立法调整利益的方式有:减少与限制利益、增加与保障利益和平衡利益,并取得了很大的成功。但是仍然存在一定立法不适当地照顾政府部门利益的问题。在立法过程中,政府部门利益缺少有效的制约与监督是症结所在。在草案起草前征询公众意见,草案形成后以及提交审议后将法律草案公开,充分运用利益相关者和公众的力量实现制约与监督政府部门利益的目的。
The function of legislation determines its ability to play an important role in the adjustment of the interests. Under the background of the reform and open policy, the ways that legislation adjusts the interests include: reducing and limiting bene- fits; increasing and guaranteeing benefits, and balancing interests. These approaches have been very successful. But there are still some problems. That is, the legislation improperly compromises the interests of the government. In the process of legisla- tion, lack of effective cheeks and supervision is the crux of the problem. To achieve the purpose of restricting and supervising the interests of government departments, we should make full use of the power of stakeholders and the publio, consulting public o- pinion before drawing up the draft, and making it open after its formation and submission for deliberation.
