摘要
财产刑执行关系到刑罚功能和司法权威的实现。当前服刑罪犯财产刑执行过程中,法院判决刑事涉财案件数量多、数额大;监狱服刑罪犯财产执行率低;监狱服刑罪犯中存在一定比例无执行能力的罪犯;部分监狱服刑罪犯存在主客观财产履行不能的困境;法院接收罪犯履行财产刑的程序机制不顺畅。服刑罪犯财产刑执行的掣肘原因包括:机械地将财产刑履行情况视同罪犯"具有悔改表现"认定的关键要素;忽视对罪犯狱外其他财产状况及其是否具有履行能力的调查与核实;对无力履行财产刑的罪犯搞"一刀切",从而产生新的不公平;财产履行存在异化为"花钱买刑"的不当趋势;法院在财产刑执行上存在执行不力、不到位的问题;人民检察院在财产刑执行上缺乏应有的监督力度。应统一财产刑履行与减刑、假释对应的幅度标准,扩大适用财产刑中止执行,引入财产刑减刑制度,建立健全对财产刑执行进行检查监督的工作机制,以更加科学合理地解决财产刑执行难问题。
The execution of property punishment is related to the function of penalty and the realization of judicial authority. At present,during the execution of property punishment of criminals,according to the court＇s decision,there are many criminal cases involve many quantity and large amount of money. The execution rate of criminal＇s property is low. There is a certain proportion of criminals without the ability of property execution. Some criminals have difficulty in property execution with subjective and objective factors. The mechanism and process of the court to accept the criminal＇s property is not smooth. The reasons for restrictions include： Firstly,the ability situation of property execution is regarded as the key factor of the criminal＇s ＂repentance＂ mechanically. Secondly,neglect the investigation and verification of criminal＇s other property outside the prison and whether it has the ability of property execution. Thirdly,the ＂one size fits all＂ approach to criminals who can not enforce the property,and lead to new injustices. Fourthly,the improper tendency of property execution alienation is ＂spend money on punishment＂. Fifthly,the court＇s law enforcement is not in place and weak of the execution of property punishment. Sixthly,the people＇s procuratorate has sometimes seemed to lacks the proper supervision of the execution of property punishment. We should unify the standard between the execution of property punishment and the commutation parole,expand the application of the suspension of Enforcement of the penalty,introduce the commutation system into the penalty,establish the mechanism of supervision and inspection of the execution of property punishment,so it is more scien tific and reasonable to solve the difficult problem of execution of property punishment.
