摘要
论文是我国近现代法律文书名词三大基本来源研究之移植篇,包括近代与当代两个时期的法律文书名词移植的研究。当代法律文书名词移植的数量多于近代。这些法律文书名词的移植也被称吸收、转用,在当代法律文书名词体系中多以"书"为后缀的形式命名,后被逐渐使用在诉讼活动中,实现了这些法律文书名词的本土化应用。
This paper is the second part of the three basic sources, whose transplantation is one of the source of the contemporary legal documents in China.It consists of two parts,which is the study of modern and contemporary legal instruments transplantterms.The contemporary transplants is more than the modern legal documents transplantation.These legal transplants is also called "absorption" and "diversion", most of which are named with the suffix of "book" in the contemporary legal documents terms system. They are gradually used in litigation and realized by the localized application of these transplant terms.
