摘要
EPC总承包模式以其独特的设计、采购、施工一体化总承包方式,在降低业主风险、大大缩短传统建设模式下的项目工期的同时,也给总承包商带来了相对较高的利润。由于EPC项目涉及到建设单位、总承包商以及分包商三方的利益,在结算过程中必然存在着诸多问题^([1]),这为EPC项目的顺利执行带来了大量的困难。业主支付竣工结算是总承包商获得利润以及回收成本的重要环节,因此总承包商做好竣工结算工作对企业自身发展尤其重要。基于总承包商视角,本文充分考虑到EPC总承包模式的特点,结合EPC项目特定的合同关系,对总承包商工程价款竣工结算做出了深入研究。
EPC general contract mode, with its unique design, procurement and construction general contracting methods, while reducing the risk of the owners and shortening the project duration under the traditional construction mode, it also brings relatively high profits to the general contractor. As the EPC project involves the interests of the construction unit, the general contractor and the subcontractors, there are many problems in the settlement process, which brings a lot of difficulties for the smooth implementation of the EPC project. The completion and settlement of the payment by the owner is an important part of the profit and recovery cost of the general contractor. Therefore, it is particularly important for the general contractor to complete the settlement of the project for its own development. Based on the perspective of general contractor, this paper fully considers the characteristics of EPC general contracting mode, combined with the specific contractual relationship of EPC project, makes an in-depth study on the completion settlement ofthe general contractor＇s project price.
