摘要
随着互联网在全世界的普及,网民数量逐年攀升。因网络虚拟账号继承所引发的问题也日渐增多。《民法总则》第127条关于网络虚拟财产问题的制定,将其法律属性界定为物权属性加以保护。笔者试图对现有的继承规则体系的完善提出相应建议,并适用《物权法》等相关法律加以规范,在发生网络虚拟账号继承事件后由继承人申请,经网络运营商审核后,根据该账号所蕴含的利益情况区别对待,便于解决网络虚拟账号纠纷在法律适用方面的问题。
With the spread of the Internet in the world, the number of Internet users has increased year by year. The problems caused by the online virtual account inheritance has appeared. Article 127 of the general provisions of civil law defines the law of virtual property as the property rights attributes. In this paper, the au-thor tries to perfect the system of the existing rules of inheritance, and apply it to the property law and other rele-vant laws. When the network virtual account inherit events happen, after examining it by the network operators, according to the different account situation, the applicable law should be adopted to deal with the network virtual account problem.
