摘要
明确的立法定位是保障《人民警察法》成功修订的前提。《人民警察法》应当定位为"人员法",而不是"组织法"或"综合法"。将《人民警察法》定位为"人员法"能够推进警察队伍职业化建设、保障警察合法权利和规范警察执法、重塑警民关系。立法定位不准会造成立法交叉重复与立法重点模糊等后果。基于"人员法"的立法定位,应当理清《人民警察法》与警察法、警察组织法和警察行为法之间的关系。同时,《中华人民共和国人民警察法(修订草案稿)》中的一些内容应当予以调整。
A clear legislative orientation is a prerequisite for the successful revision of the People＇s Police Law. The People＇ s Police Law should be targeted at＂ personnel law＂, not ＂organization law＂ or ＂comprehensive legal＂. The People＇s Police Law, which is positioned as ＂Personnel Law＂, can promote the professional construction of the police force, protect the legitimate rights of police, standardize the police law enforcement and reshape the relationship between the police and the people. Once the legislative position is inaccurate, it will result in repeated cross-legislation and legislative emphases. Based on the legislative orientation of ＂Personnel Law＂, we should clarify the relationship between the People＇ s Police Law and the police law, police organization law and police behavior law. At the same time, some of the contents of the People＇s Police Law （Revised Draft） should be adjusted.
