摘要
职业索赔者在食品和药品领域与非食品和药品领域如何适用惩罚性赔偿规定等难点问题至今未能统一和规范。职业索赔者应认定为特殊的购买者而非消费者。在非食品和药品领域,其未受欺诈且不符合消费者主体资格,法律应排除其在该领域内适用惩罚性赔偿规定;在食品和药品领域,法律对其适用惩罚性赔偿规定亦应作出更为严格的限制。通过明确职业索赔者的主体地位,完善相关法律制度,合理确定惩罚性赔偿金数额等立法或司法解释手段,配合司法与行政多渠道的协同努力,可共同引导职业索赔行为走向规范。
There is still no unity and standardization for the issue on application of punitive compensation for professional claimants in the field of food,medicine,non-food and non-medicine.Professional claimants should be identified as special purchasers rather than consumers.In the non-food and non-pharmaceutical areas,in which they are not subject to fraud and do not meet the consumer's subject qualification,the law should exclude its application of punitive damages in these areas;and in the food and pharmaceutical areas,the law should also impose more stringent restrictions on its application of puni-tive damages.It could jointly guide the professional claims to the standardization by clarifying the subject status of profes -sional claimants,perfecting the relevant legal system,reasonably determining the legislative or judicial interpretation such as the amount of punitive damages,and combining with judicial and administrative collaborative efforts of multi-channels.
