摘要
在控制死刑的实际执行上,死缓制度扮演着举足轻重的角色,这也被视作我国刑事立法中的创举。但着眼于进一步推进死刑限制适用,死缓制度的功能定位与具体设置都还有改良的空间,应当将死缓定位为"死刑适用的主要方式"而非"死刑立即执行的替代措施"。在此定位下,死缓将成为死刑执行的常态,而死刑立即执行则是特殊情形下的例外。在具体操作上,可以通过死缓与死刑立即执行的"地位调换"来促成死缓定位的转变。
In the control of the actual execution of the death penalty,the death penalty system plays an im portant role,which is also regardedas a major innovation in China＇s criminal legislation.
