摘要
"一带一路"沿线国家的国情不同,采用传统纠纷解决方式解决国际商事争议面临司法管辖、法律适用等方面难题。调解制度具有独特的文化优势,是一种高效、便利的纠纷解决方式。然而,通过调解达成的和解协议,其执行力具有不确定性。在我国,经由商事调解机构的调解程序形成的和解协议并不具有执行力,其执行主要依靠诉讼程序或仲裁程序来保障,这不利于调解制度的发展和完善。我国需要制定统一的"商事调解法",对包括民间调解组织在内的商事调解机构制作的和解协议的效力给予明确的法律保障。同时,要严格实施信用惩戒制度,实现商事调解制度与信用惩戒制度的有机结合,推动有关各方对失信被执行人进行联合惩戒。
Due to different situations of countries along the " One Belt and One Road",the traditional dispute settlement to solve the international commercial disputes faces the problems of jurisdiction,law application and so on. The mediation system has unique cultural advantages,and it is an efficient and convenient solution for dispute settlement. However,the settlement of the agreement through mediation has uncertainty in its execution. In China,the settlement agreement formed by the mediation procedure of commercial mediation agency does not have executive power,and its implementation relies mainly on the litigation procedure or the arbitration procedure,which is not conducive to the development and improvement of the mediation system. China needs to formulate a unified " commercial mediation law",which provides a clear legal guarantee for the effectiveness of the settlement agreement made by commercial mediation organizations including civil mediation organizations. Meanwhile,we should strictly implement the system of credit punishment,realize the organic combination of the commercial mediation system and the credit disciplinary system,and promote the joint punishment of the debtor who breaks the faith.
