摘要
逻辑是研究证据不可或缺的知识要素,它贯穿于系统的证据分析过程始终。在英美理性主义证据研究的传统中,逻辑知识已融入证据研究的诸多领域,它们既是英国现代证据法研究中的认知理念和基础,也是美国当代证明科学中的理性工具和分析路径。概括并审视逻辑在证据研究中的功能和定位,冀期给予国内证据和逻辑交叉研究提供有益借鉴。
Logic is an indispensable element of knowledge, which runs through the whole process of evidence analysis. In the tradition of Anglo-American evidence scholarship, logic knowledge has been integrated into many fields of evidence research. They are not only the cognitive concept and basis of the study of modern evidence law in the United Kingdom, but also the tools and methods of analysis of the contemporary science of proof in the United States. By summarizing and examining the function and orientation of logic in the study of evidence, in order to provide a useful reference for crossover study between evidence and logic at home.
