摘要
社会转型时期,官民矛盾不断激化,群体性事件时有发生,已经成为威胁社会稳定的重要问题。从法治政府的视野透析,传统官民关系的观念影响甚广。官民协商及解纷机制不顺畅,以及行政权力的监督体系不健全,是导致当今官民矛盾激化的主要因素。因此,要有效化解官民矛盾,需要在法治观念上,重塑新型官民关系的认识;在制度建设上,要优化多元利益表达和行政争议解决机制;在法治实践上,要勇于将行政权装进制度的笼子。
In the socialtransformation period, the mass disturbances occasionally occur with contradictions being increasingly intensified between the officials and the masses,which has posed a great threat on social stability. A dialysis from the perspective of a law-based government suggests that the concept of traditional relationship between the officials and the masses has profound influence.The principal factors causing aggravation of contradictions between the officials and the masses are attributed to defective consultation and disputes settlement mechanism and supervision system for administrative power. Therefor, effective resolution of contradictions between the officials and the masses calls for remodeling of our knowledge of new-type officials-masses relationship in the concept of rule of law,optimization of pluralistic interests expressions and administrative disputes settlement mechanism in system construction,and institutionalization of administrative power.
