摘要
调查取证,是行政执法中的重要环节,是作为行政决定的前提条件,收集调取的证据不仅要符合客观真实,还要符合证据规则的相关要求。笔者在担任政府法律顾问期间,深切感受到执法主体的疑虑往往来自于实际履行职责过程中的调查取证阶段,经过收集整理形成此文,以期有益他人。
Investigation and evidence collection,is an important part o~ the administrative law enforcement,is a prerequisite for administrative decisions,the collection of evidence not only to meet the objective reality,but also in line with the relevant requirements of the rules of evidence. During the period of legal counsel,I deeply feel that the main body of the law enforcement is often from the actual investigation and evidence collection in the process of fulfilling the duty.
