摘要
检察机关在民事虚假诉讼监督中发挥着重要作用,但也面临线索发现难、调查核实权受限、监督范围狭窄等困境。加强对虚假诉讼的检察监督,可以试水"监督前移",增强对人民法院在立案登记和案件审理阶段的监督,拓宽案源渠道。同时,延伸调查触角,探索"引导侦查"工作机制,发挥检察监督在案件移送阶段的作用。此外,完善对虚假调解的立法,建议扩大对虚假调解的抗诉范围和以支持起诉方式对侵犯第三人合法权益的虚假调解予以救济。
The procuratorial organs which play a vital role in the supervision of civil false litigation are faced with many difficulties in the search of clues,investigating and verifying limits,and narrowing of the scope of supervision. To strengthen the procuratorial supervision of civil false litigation,one can try to move forward to enhance the supervision of People＇s Court in the filing registration and the trial stage of the cases,thereby broadening the channels of the cases. It can also help extend the investigation tentacles,explore the mechanism of ＂guided investigation＂,thus playing the role of procuratorial supervision in the case transfer stage.In addition,for the ideal legislation of false mediation,it is proposed to expand the scope of protest against false mediation and to support the prosecution of the violation of the legitimate rights and interests of third parties to the false remedy.
