摘要
我国尚未建立死刑适用案例指导制度,而清代秋审成案机制对清代司法官适用死刑起到较大指引作用,可资借鉴。在对清代秋审成案的产生主体、具体类型、论证方式、司法效力以及时间效力等方面进行研究的基础上,对我国现有案例指导制度进行了分析,指出其存在基本问题认识不清、司法实践困难等问题。建议借鉴清代秋审成案机制的相关制度,从案例制度本身和司法适用2个方面构建我国死刑适用案例指导制度。
China has not established a case guidance system in the application of the death penalty,yet the mechanism of the autumn trial in Qing Dynasty has played a large role in the application of the death penalty to the judges of the Qing Dynasty. Therefore,based on the investigation of main body,specific type,way of argumentation,judicial effect and time effect of the autumn court in Qing Dynasty,this paper analyzes the current case guidance system in our country and points out problems including the vague understanding of fundamental issues,difficulties in judicial practice and etc. Therefore,this paper argues that we should learn from the relevant system of the autumn trial mechanism in Qing Dynasty,and we should use the case system itself and the judicial application to construct the case guidance system of death penalty application in China.
