摘要
法律是社会控制的主要工具是庞德社会控制论法学的主要思想。该思想具有强调法律的"强力"、法律的社会价值以及社会控制手段的理性化等特征,实现了社会学与法学的交融,对美国的立法、司法都产生了重大影响。庞德的这一思想协调个人利益与公共利益、社会利益的关系,为我国依法治国提供了一定的理论借鉴。
Law is the main tool of social control and the main idea of Pound＇s social cybernetics. This idea has the characteristics of emphasizing the ＂strong＂ of law, the social value of law and the rationalization of social control means, and realized the integration of sociology and law, which has had a great influence on the legislation and judicature of the United States. This idea of Pound coordinates the relationship between individual interests and public interests and social interests, and provides a theoretical reference for the rule of law in our country.
