摘要
大学教师聘任制度的规范文本表达的是"法律的逻辑",是规范制度操作中"有可为"与"有可不为"的指导性文件,是制度的表层。由表及里,可以发现任何一个制度设计背后,都体现着一定的治理理念,表达着权力的分割博弈及其运行模式,这体现出制度的"治理逻辑"。香港地区大学教师聘任制度的"治理逻辑"表现为:学术制度运作的"分层负责制"、学术治理"权力的转授"、"学术卡里斯玛"与"教授治校"、"官僚制"下的"民主制"。这契合了新公共管理理论所倡导的"分权"、"权力重心下移"、"公共问责"和"绩效管理"等观点。
Normative texts of appointment system for university faculty deliver "logic of law", are guide documents of "can do" and "cannot do" in operation of standardized system, and also, the surface layer of the system. From the outside to the inside, it can discover that the design of every system has certain governing ideas, describing the separation and game of powers and its operation pattern, which shows "governance logic" of the system. Governance logic of appointment system for university faculty in Hongkong represents as "decentralization of responsibility" in academic system, "delegation of power" in academic governance, "academic Charisma" and "spirit of professorial governance", and "democracy" un- der "bureaucrat system", which are relevant with viewpoints advocated by new public management as "separation of powers", "the center of powers shifts downwards", "public accountability" and "performance management".
