摘要
地方官员生态环境损害责任追究是建设生态文明和实现绿色发展的有效途径,党政同责和终生追责,既抓住了问责的关键少数,又规定了问责时限。当前,我国形成了环境保护法为主轴、各专门法律为支撑、法规条例和配套政策为补充的生态环境责任追究的基本架构。只是一些地方官员对于生态环境责任追究执行的不彻底或者变通执行,这需要根据实践来适时调整完善之。我国地方官员生态环境损害问责实践中存在的问题:权责不明、认识偏差、规避问责和问责执行不到位。解决路径在于制定生态环境保护责任清单、建立地方官员生态政绩考评机制、元问责机制和复出机制。
The accountability of the local officials for the damage of ecological environment is an effective way to build ecological civilization and achieve sustainable development. The practice of sharing responsibilities between the party and the government, and lifetime accountability not only holds the major minorities accountable, but also stipulates the deadline of accountability. So far, a basic framework for the accountability of ecological or environmental damage has been formed with the Law of Environmental Protection as its pivot, other specific laws as support and other regulations and supporting policies as compensations. Nevertheless, some local officials conduct incomplete or even accommodative performance of accountability in claiming damages to the ecology or environment, which needs timely readjustment and improvement. Currently, the problems with such accountability are： the ambiguity of the power and duties, the deviation of understanding, evasion and the inadequate implementation of the accountability. The solution is to list the responsibilities of protecting ecological environment, establish mechanisms for evaluation of the ecological performance, initial accountability and return of the local officials.
