摘要
1978年的改革开放是民族地区农村土地流转制度演变的分界线。改革开放前的民族地区农村土地流转可分为农民土地所有制基础上的零星流转和土地集体所有制基础上的禁止流转两个阶段;改革开放后的民族地区农村土地流转又可分为土地流转的探索、土地流转的发展、土地流转的规范和土地流转的创新四个阶段。通过对民族地区农村土地流转制度进行纵向的梳理,可以得出不同时期民族地区土地流转的特点,并在此基础上得出有益的启示,即生产力发展水平是民族地区农村土地制度改革的前提,是否尊重群众意愿是民族地区农村土地制度改革成败的关键,从"两权分离"到"三权分置"是民族地区农村土地制度变迁的趋势。
The reform and opening up in 1987is the boundary of the evolution of rural land circulation in ethnic minority areas.The rural land circulation in ethnic minority areas before the reform and opening to the outside world can be divided into two stages,namely,the sporadic transfer of farmers’land ownership system and the prohibition of circulation on the basis of collective ownership of rural land.After the reform and opening up,the rural land circulation in the ethnic areas can be divided into four stages:the exploration of land circulation,the development of land circulation,the standardization of land circulation and the innovation of land circulation.Through the vertical combing of the rural land circulation in the ethnic areas,we can get the characteristics of land circulation in different regions in different periods.It can be concluded that the development level of productive forces is the premise of the reform of rural and circulation in ethnic minority areas,and whether to respect the wishes of the masses is the key to the success or failure of the rural land circulation reform in the ethnic areas.And from the'Two Rights Separation'to'Three Rights Separation'is the rural land system changes in ethnic minority areas.
