摘要
少数民族文化知识产权保护对于少数民族传统文化的保存、延续和发展具有非常重要的作用。无论是国际条约还是其他国家,都有很多关于少数民族文化知识产权保护的相关立法可资借鉴。由于传统知识财产权与少数民族文化知识产权之间有比较大的隔阂,运用传统知识财产权无法完全保护少数民族文化,因此建议对少数民族文化知识产权保护进行特别立法。
The protection of intellectual pro petty rights of minority culture plays a very important role in the preservation, continuation and development of traditional culture of ethnic minorities. There are lots of legislations on the protection of intellectual property rights of minority culture in international law or other country＇ s law. There are so many differences between traditional intellectual property rights and intellectual property rights of minority culture that traditional intellectual property rights can not protect the minority culture properly, so we suggest making a special law about it.
